                                           Public Hearing - August 27, 2002 - Draft

Others Present: John Ambrose, Annette McNamara

 Marion Township Application for Rezoning

Discussion on the need to rezone Parcel 4710-02-400-016.  John Ambrose suggested a review 

of the proposed rezoning, addressing several issues. Mr. Ambrose will create a written

analysis to be reviewed by the Planning Commission at the September 17 meeting.

Meeting called to order at 7:29 p.m. by Lowe.

Approval of the Agenda

Motion by Musson, seconded by Root to approve the agenda. 

Motion carried.

Approval of  Minutes - Motion by Hamann, seconded by Musson to approve the 

July 23, 2002 Public Hearing Minutes. Motion carried 3-0, Root abstained.  

Per D. Hamann, amend regular meeting minutes to starting time of 7:30 pm instead

 of 7:15 pm.  Hamann motioned to approve the amended minutes for the regular meeting

held on July 23, 2002 @7:30 pm. Musson seconded. Motion Carried 3-0, Root abstained.

OLD BUSINESS:                                           

Single Family Cluster Housing Options -: Mr. Ambrose addressed several issues from the 

Planning Commission Members with questions on his letter dated August 19, 2002. Mr. Ambrose 

stated these revisions were based on suggestions from Mr. Kehoe's recommendations

 outlined in the July 2, 2002 letter. Mr. Ambrose will make the following changes:

  *Item #4 6 a - add verbiage to allow the Planning Commission the right to decide if trees or a berm

should be used based on the site plan being reviewed.

   *Item #9 a - delete the word "detached" so it will apply to all housing.

  *Item #2, the item number, is missing - will be corrected.

  *Add verbiage stating site plan review is required.

Mr. Ambrose will make the above revisions and forward to Zoning Administrator.

Public Hearing set for September 24, 2002. 

Motion made by Root to table Single Family Cluster Housing Option until Sept. 24, 2002, at which 

time a Public Hearing will be held at 7:15 pm., Hamann seconded. Motion Carried 4-0. 

Jesse Drive -   Pat Keough stated he has worked with the Road Commission regarding previous items 

of discussion, modifications have been made and he has their approval. He is requesting approval for 

private road and parcel splits. Mr. Ambrose spoke about outstanding issues. Parcel #4 has a free 

standing barn which is not permitted and must be eliminated, no variance can be granted, he feels the plan 

can be approved although Mr. Kehoe's letter dated August 27, 2002 recommends it can be denied based

on not meeting LCRC standards. Motion by Musson, seconded by Hamann to conditionally approve the 

Jesse Site Plan submitted, subject to ZBA Variance approval and final approval from Planning Commission.

Motion Carried 4-0.

Marion Township Application for Rezoning - Tabled until September 24, 2002.                                                                                                                                                                                                                                                                                                                                                                                                              NEW NEW BUSINESS: 

Hometown Village Development Amendment  - Todd Hallett is requesting a setback of 20 feet on all lots.

 Perimeter lots will maintain a 25 foot setback. Discussion. Motion made by Root to recommend to the 

Marion Township Board to amend the Hometown Village Site Plan to reflect any house that requires more

 than a 70 foot building envelope be allowed a 20 foot setback, with some restrictions on certain lots including

any lots currently in development or already sold. Musson seconded. Motion carried 4-0.

CALL TO THE PUBLIC: 

None.

Per John Lowe, Turtle Creek development on Norton Road has placed high output quartz lights at entrance.

Residents are complaining regarding excessive light. Site plan should state lighting requirements and will

be reviewed by Zoning Administrator. Root noted residents should be directed to make formal complaints

in writing.

Adjournment: Motion by Hamann, seconded by Root to adjourn the Meeting at 8:56 pm. Motion Carried 4-0.
