CALL TO ORDER

Jack Lowe called the meeting to order at 7:30 p.m.

APPROVAL OF AGENDA

The following changes were made to the agenda; 1) item #1 c, Crematory definition, under Old Business to be moved to New Business; 2) add Section 3.02 Figure 3-8 Cul-de-Sac diagram under New Business; 3) add discussion on Text Amendments & Ordinance process under New Business.  Dave Hamann motioned to approve the January 9, 2007 regular meeting agenda as amended.  Jean Root seconded.  Motion Carried 5-0.

APPROVAL OF MINUTES

Dave Hamann motioned to approve the October 10, 2006 special meeting minutes as amended.  Jean Root seconded.  Motion Carried 4-0.  John Lowe abstained. 

Jean Root motioned to approve the November 13, 2006 special meeting minutes as submitted.  Jim Anderson seconded.  Motion Carried 4-0.  Dave Hamann abstained. 

OLD BUSINESS

CEMETERY, FUNERAL HOME & CREMATORY – PROPOSED TEXT AMENDMENTS

John Enos noted this is a work in progress.  There have been changes made and new amendments added.  With that the Planning Commission members reviewed the proposed text amendments.

Section 3.02 amend Cemetery definition – remove Crematories

A public hearing has been held on this agenda item.  No changes have been made.

Jean Root motioned to hold this proposed text amendment until other related information on crematories and funeral homes is finalized.  Dave Hamann seconded.  Motion Carried 5-0.

Section 3.02 add Funeral Home definition

Clarification on crematory services has been added to this definition and a public hearing has been held.

Section 8.01 E remove crematories from item #19

A public hearing has been held on this proposed text amendment.  No changes have been made.

Section 8.02 E remove crematories from item #4

A public hearing has been held on this proposed text amendment.  No changes have been made.

Section 9.01 B add item #16 Funeral Homes with Crematory Services & sub section E add item #10 funeral homes performance standards

Per the Planning Commission request item 9.01 B #17 has been added along with item 9.01 E #11.  John Enos suggested an additional public hearing be held for this change.

Jean Root motioned to hold a public hearing on February 13, 2007 @ 7:30 p.m.  Dave Hamann seconded.  Motion Carried 5-0.

Section 17.07 remove crematories from location requirements & site requirements

A public hearing has been held on this proposed text amendment.  No changes have been made.

Jean Root motioned to hold this proposed text amendment until other related information on crematories and funeral homes is finalized.  Dave Hamann seconded.  Motion Carried 5-0.

Section 6.27 Zone A prohibited uses list delete graveyard & cemeteries item #9

The Planning Commission members agreed to remove item #9 in its entirety and renumber the list.

Jean Root motioned to hold a public hearing on February 13, 2007 @ 7:30 p.m.  Dave Hamann seconded.  Motion Carried 5-0.

Section 3.02 – Crematory definition

The Planning Commission members are satisfied with the definition.

OLD BUSINESS

Community Waste Water Utility Systems – Proposed Text Amendments

The Planning Commission members reviewed the January 3, 2007 memo from the Board of Trustees regarding proposed text amendments.  The Planning Commission requested the following changes.

1)      Page 1 of 6 - Section 3.02 Community Waste Water Utility Systems; remove or “Systems” and add the word residential to the third sentence

2)      Page 2 of 6 - Section 17.31 B 1 d. remove ‘relative to current conditions and projections for fifteen (15) years in the future

3)      Page 3 of 6 – Section 17.31 B 1 e iv remove ‘system’ and insert utility building

4)      Page 3 of 6 – Section 17.31 B 1 e vi to read ‘the location of existing and future structures, drains, water mains, and other utilities within the proposed development and five hundred feet from the proposed development’

5)      Page 3 of 6 – Section 17.31 B 1 e vii – to read ‘the location of surface water, wetlands, and floodplains within five hundred feet of the proposed development

6)      Page 3 of 6 – Section 17.31 B 1 e xi – add the word public between existing and water

7)      Page 3 of 6 – Section 17.31 B 2 g to read ‘A list of all conditions placed on the subject community wastewater utility system as noted by the agencies listed in items a-f above

8)      Page 4 of 6 Section 17.31 C 2 – remove the words ‘shall not’ and insert ‘may’ serve (note; John Enos will contact the Livingston County Department of Public Health for input)

9)      Page 4 of 6 – Section 17.31 C 5 – add meeting current Marion Township Engineering Standards

10)   Page 4 of 6 – Section 17.31 C 10 – delete in its entirety.

11)   Page 4 of 6 – Section 17.31 C 11 – to read ‘Unless it is determined, in the sole discretion of the Township Board, the proposed development to be served by the system provides a recognizable and material benefit to the community and/or provides long-term protection of natural resources and environmental features

12)   Page 5 of 6 – Section 17.31 D 5 b – to read ‘Ten (10) feet from public parking and roads

13)   Page 5 of 6 – Section 17.31 F 2 – delete collection and add treatment

John Enos will review the proposed General Ordinance for any changes in relationship to the proposed text amendments.  He will contact Diane McCormick, Livingston County Department of Public Health about 2,000 feet from well head and commercial in SR PUD.

Debra Wiedman-Clawson left the meeting @ 9:00 p.m.

Jean Root motioned to table this agenda item to the January 30, 2007 regular meeting, John Enos to make amendments and provide a clean copy along with answers to questions asked tonight.  Dave Hamann seconded.  Motion Carried 4-0.

6.20 A – New Private Roads Serving Single-Family, Multiple-Family and Commercial Developments

The Planning Commission members requested the following changes.

1)      Page 5 of 5 add ‘final course upon completion’

2)      Change all reference to Livingston County Road Commission standards to Marion Township Engineering Standards.

Jean Root motioned to table this agenda item to the January 30, 2007 regular meeting.  Dave Hamann seconded.  Motion Carried 4-0.

6.19 B – Lots to Have Access

Jean Root motioned to table this agenda item to the January 30, 2007 regular meeting.  Jim Anderson seconded.  Motion Carried 4-0.

Mobile Home Park Discussion

Jean Root motioned to table this agenda item until a member of the joint committee requests placement on an agenda.  Dave Hamann seconded.  Motion Carried 4-0.

NEW BUSINESS

Section 3.02 – Figure 3-8 Front Set Back measurements on a Cul-de-Sac

The Planning Commission members are satisfied with the diagram.

CALL TO THE PUBLIC

Charles Musson – 333 Triangle Lake Road asked what Marion Township would do if a developer received Michigan Department of Environmental Quality approval for an on-site sewer system for more than 33 lots.

John Enos answered it is up to the Livingston County Department of Public Health, depending on the system.  He will ask Diane McCormick and Brighton Township what they did in that situation.
